Redemption Statement & Original Title Deed

Mengikut Circular 34/2009 daripada Bar Council, semua bank di Malaysia hendaklah menghantar penyata baki hutang dan semua dokumen asal kepada peguam dalam masa 7 hari selepas peguam menghantar surat kepada pihak bank. Paling lewat pun adalah dalam masa dua minggu. Kalau ada mana-mana bank yang hantar lewat, peguam dan/atau peminjam boleh terus membuat laporan kepada Bank Negara untuk tindakan lanjut.

Ini adalah satu perkembangan yang baik. Mengikut pengalaman saya, jarang sekali pihak bank akan balas surat dari peguam dalam masa seminggu. Kalau dapat dalam masa dua minggu pun dah cukup baik. Selalunya memang lebih dua minggu bahkan ada yang ambil masa sampai sebulan. Harapnya selepas ini pihak bank akan lebih produktif.

Apa pula kesnya dengan permohonan baki hutang dari Bahagian Pinjaman Perumahan (BPP). Pihak kerajaan tak letakkan apa-apa standard time frame ke? BPP lagi hampeh, tak pernah dapat dalam masa minggu. Confirm kena tunggu bulan-bulan.

Issuance of Redemption Statement and Release of Original Title of Property

Following representations made by the Bar Council (through its Conveyancing Practice and Corporate and Commercial Law Committees) to Bank Negara Malaysia, the latter ruled at a meeting with the Bar Council on 10 July 2007 that banks to which properties have been charged must forward redemption statements to the relevant chargors or their solicitors within seven (7) days from the date of request therefor, but in any event not more than two (2) weeks therefrom .

Bank Negara Malaysia has additionally confirmed that if there is a delay of more than two (2) weeks, members of the Bar may write to them directly for appropriate action and/or intervention.

In this connection, we understand that Bank Negara Malaysia has issued a circular notifying all banks and financial institutions of the time frame for issuance of the redemption statement.

Members may refer any incidents of delay to the Corporate and Commercial Law Committee in order that the matter may be raised with the senior management of the banks concerned. At the same time, we trust that members will afford their fullest cooperation to banks to expedite and facilitate the discharge of charges.
